ONLINE DISCIPLINE REGISTRY
Pursuant to sections 89(3)(a) & (b) and 41(2)(e) & (f) of the Veterinarians Act, S.B.C. 2010, c. 15 (the 'Act'), the CVBC is mandated to include, in its online registry of registrants and former registrants whose registration has been cancelled for less than one year, a record of all disciplinary actions, if any, taken in respect of the individual, and the reasons for the action, along with a notation of all cancellations and suspensions, if any, of the individual's registration, taken not more than 5 years prior to September 15, 2010.
Pursuant to section 89(3) of the Act, Council has limited discretion to direct the registrar to withhold or remove such information from the online registry.
The following is a summary of the decisions of the BCVMA resulting in disciplinary actions, cancellations or suspensions issued by the BCVMA / CVBC after September 15, 2005.

Section 68 of the Veterinarians Act requires the Investigation Committee (IC) or the Discipline Committee (DC) to direct the Registrar to give public notice on the CVBC website of all Remedial Actions by Consent (RAC) and Consent Orders (CO) by posting the name of the registrant, along with the description of the action taken along with the reasons for the action taken.

Order: The Investigation Committee has imposed the following interim limit(s) on the practice of veterinary medicine by Dr. Drosdovech pending the outcome of their investigation:
- the registrant may not prescribe or administer substances which are not approved by Health Canada, including 'Neoplasene',
- for greater certainty, the registrant may not use the substance 'Neoplasene' for any purpose whatsoever,
- for greater certainty, the registrant is not entitled to access any substance through the Health Canada Emergency Drug Release Program.
The Investigation Committee considers that the Order is necessary in the public interest to take this action in order to protect animals from an immediate risk to their health or safety.

Decisions: CVBC Investigation Committee (February 16, 2013)
Order: The Investigation Committee has suspended the registrant pursuant to section 65(2)(b) of the Veterinarians Act.
The Investigation Committee has taken this extraordinary action to protect the public interest due to the number and seriousness of formal complaints received by this office alleging sexual misconduct involving women, both employees and clients. Although unproven at this time, these allegations, if proven, suggest a high degree of professional misconduct and conduct unbecoming a registrant that extraordinary action to protect the public interest must be taken.
Further, that the terms of a prior order of the Investigation Committee (February 15, 2013) which provided the option of continued veterinary practice under the supervision of a chaperone were not adhered to, in that the Registrar (Interim) of the CVBC was not contacted before 4:30 p.m. on February 15, 2013 for directions regarding the assignment of a chaperone.
PART II - HEARING OUTCOMES

Registrant: Dr. Arminder Brar
Inquiry Number: 05-01
Decisions: BCVMA Inquiry Committee (October 6, 2006); BCVMA Council (March 27, 2007)
Findings: In relation to Canine A, Dr. Brar failed to use a level of care, skill and knowledge expected of a reasonably competent practitioner in the advice and management of treatment in that he recommended the amputation of the third phalanx of the affected digit which was unjustified and constituted excessive treatment; and, in relation to Canine B, Dr. Brar failed to use a level of care, skill and knowledge expected of a reasonably competent practitioner to understand the pathology and treatment of immune mediated thrombocytopenia (IMTP). Council found that Dr. Brar engaged in unprofessional conduct.
Disposition: Council issued Dr. Brar a formal reprimand and suspended him from practice for a period of one month. Council issued a restriction that Dr. Brar not treat and must refer any immune mediated disease cases until completing remedial training of a minimum three weeks duration. Dr. Brar was required to pass an exam on the subject of diagnosis and treatment of immune mediated diseases of small animals and to pay the costs of the inquiry.

Findings: In relation to a Feline A, Dr. Sharma failed to use a level of care, skill and knowledge expected of a reasonably competent practitioner and failed to create, maintain and keep current a medical record containing appropriate detail.
In relation to a Feline B, Dr. Sharma failed to use a level of care, skill and knowledge expected of a reasonably competent practitioner in the level of performance of a tendonectomy; failed to obtain informed consent as to the services to be provided; failed to create, maintain and keep current a medical record; falsified, deliberately, the medical record and made misleading statements to the client regarding the performance of a tendonectomy; falsified, deliberately, the medical record, with the intent to mislead the Complaint Officer; and, made misleading statements to the Complaint Officer that he did not perform a tendonectomy when he knew the statements to be untrue. Council found Dr. Sharma guilty of unprofessional conduct.
Disposition: Dr. Sharma was suspended from practice for one year and ordered to pay a fine of $5,000 and the costs of the inquiry. Council imposed a practice restriction that Dr. Sharma not perform declaws (onychectomies) and tendonectomies until he wrote and passed an examination on these procedures. Council also required Dr. Sharma to write and pass the BCVMA Bylaws and Ethics examination before being reinstated to practice.

Decisions: BCVMA Inquiry Committee (April 20, 2007); BCVMA Council (October 12, 2007)
Findings: In relation to a feline, Dr. Jagpal failed to provide the appropriate level of care, skill, and knowledge expected of a reasonably competent practitioner and failed to prepare and maintain a medical record containing appropriate detail of the history, examination, diagnosis, recommendations and treatment including medications prescribed and administered, referrals and other pertinent information.
In relation to a canine, Dr. Jagpal failed to obtain informed consent as to the services to be provided to a patient by not providing the clients with the information including advice, reasonably required, to enable the clients to make informed choices concerning the health care of their animal; failed to use a level of care, skill and knowledge expected of a reasonably competent practitioner in the advice and management of the treatment; and, failed to maintain and keep current a medical record containing appropriate detail of the history, examination, diagnosis, recommendations, and treatments, including medications prescribed and administered and other pertinent information pertaining to the patient. Council found Dr. Jagpal guilty of unprofessional conduct.
Disposition: Dr. Jagpal was suspended from practice for a period of three months and was ordered to take a course on medical records prior to the re-instatement of his license. Dr. Jagpal was restricted from performing fracture repair until taking and demonstrating attendance in a course on orthopedic surgery and was required to pay a fine of $5,000 and the costs of the inquiry.

Decisions: BCVMA Inquiry Committee (September 18, 2008); BCVMA Council (February 20, 2009)
Findings: Dr. Bajwa failed to respond promptly and appropriately to letters from a complaint officer in complaint investigations on several occasions, made unprofessional and inappropriate comments about the integrity of a complaint officer, and failed to maintain a complete and proper medical record on a patient. Council found Dr. Bajwa guilty of unprofessional conduct.
Disposition: Council imposed the following penalty on Dr. Bajwa: a reprimand, a requirement to take a specific medical records course and a fine of $ 10,000.
Registrant: Dr. Robert Ashburner
Inquiry Number: 08-03
Decisions: BCVMA Inquiry Committee (November 28, 2009); BCVMA Council (June 20, 2009)
Findings: During a private meeting which was secretly recorded, Dr. Ashburner failed to respect the dignity and professional status of a fellow member and belittled, injured or made careless, critical comments on the professional standing or actions of another member. Council found Dr. Ashburner guilty of unprofessional conduct.
Disposition: Council issued a warning to Dr. Ashburner that the duty a veterinarian owes to fellow members to respect their dignity and professional status must be observed at all times. Council stated that it is never acceptable to belittle, injure or make careless critical comment on the professional standing or actions of another member, regardless of the circumstances.

Decisions: BCVMA Inquiry Committee (September 16, 2008); BCVMA Council (December 4, 2009)
Findings: File 03-078(a) - In relation to Canine A, on which Dr. Bhullar performed a debarking surgery, Dr. Bhullar failed to exercise a reasonable degree of care, skill and knowledge with respect to intra-operative and post-operative care; failed to obtain the informed consent of the owner prior to performing the debarking surgery; misled the owner with respect to Dr. Bhullar's experience in performing the debarking surgery; failed to refer Canine A to another appropriate veterinarian for follow-up care; failed to exercise a reasonable degree of care, skill and knowledge with respect to follow-up care after debarking surgery; failed to release the medical records of Canine A within a reasonable time after a request for those records was made by a succeeding veterinary caregiver; failed, without reasonable excuse, to respond within a reasonable time to a request by the BCVMA for the release of Canine A's records and misled the BCVMA in this regard; and, fabricated a portion of the medical records concerning Canine A with respect to debarking surgery and post-operative care.
File 04-001 - Dr. Bhullar failed to release, in a full and timely manner, the medical records of Feline A to an authorized subsequent veterinary caregiver.
File 04-007 - In relation to Canine B, Dr. Bhullar failed to create adequate medical records and recorded incorrect information in the medical records; failed to exercise a reasonable degree of care, skill and knowledge with respect to diagnosis and treatment; and, failed to release medical records to a subsequent authorized veterinary caregiver in a timely manner.
File 04-052(b) - Dr. Bhullar misrepresented his identity to the owners of Feline B and concealed his own identity while dealing with the said owners with respect to a complaint made against another veterinarian; attempted through the promise of money to induce the owners of Feline B into withdrawing a complaint made to the BCVMA; misled a notary public into participating in a scheme in which Dr. Bhullar misrepresented his identity to the owners of Feline B and improperly secured an affidavit from them withdrawing a complaint; failed to respond to communications from the BCVMA; and, improperly impugned the care provided by another member of the BCVMA with respect to Feline B.
File A04-040 & 04-067 - Dr. Bhullar contravened certain marketing guidelines of the BCVMA.
Council found Dr. Bhullar guilty of unprofessional conduct.
Disposition: Council concluded that Dr. Bhullar was not a governable member of the BCVMA. Council ordered Dr. Bhullar to pay the costs of the inquiry to the BCVMA and directed that his name be erased from the register.
Two members of Council, in minority, while agreeing that erasure and payment of costs was appropriate, recommended that Council entertain an application by Dr. Bhullar for reinstatement as a member of the BCVMA after a period of four years.
Registrant: Dr. Andrew Jones
Inquiry Number: 09-01
Decisions: BCVMA Inquiry Committee (April 20, 2010); CVBC Council (September 20, 2010)
Findings: Dr. Jones engaged in marketing practices in contravention of the Bylaws and violated written undertakings he provided to the BCVMA regarding his marketing practices. Council found Dr. Jones guilty of unprofessional conduct.
Disposition: Council issued Dr. Jones a formal reprimand and a warning against future violations of the Bylaws. Dr. Jones was ordered to pay a fine of $20,000 for violating the marketing guidelines, a fine of $10,000 for violating his two personal undertakings to the BCVMA, and the costs of the inquiry.
Registrant: Dr. Stephen Harvey

Decisions: BCVMA Inquiry Committee (May 25, 2010); CVBC Council (November 13, 2010)
Findings: In relation to a canine, Dr. Harvey failed to use a level of care, skill and knowledge of a reasonably competent practitioner in the advice and management of treatment and failed to create, maintain and keep current a medical record containing appropriate detail of the history, examination, diagnosis, recommendations and other treatment, including medications prescribed and administered, and other pertinent information pertaining to the client. Council found Dr. Harvey guilty of unprofessional conduct.
Disposition: Council issued Dr. Harvey a formal reprimand. Dr. Harvey was ordered to pay a fine of $10,000 and the costs of the inquiry in the amount of $5,000. Council directed Dr. Harvey to undertake not to prescribe the drug dipyrone in canine patients, to complete a course on medical records and, in addition to his yearly continuing education requirements, to complete 30 additional hours in Pharmacy, Critical Care and Internal Medicine.

Decisions: CVBC Discipline Committee - August 7, 2012 (Decision); November 13, 2012 (Penalty).
Findings: The Discipline Committee found that Dr. Bratt failed to comply with the Veterinarains Act, a regulation or bylaw on each of the following three counts;
1. Dr. Bratt admitted that he engaged in misconduct by moving his facility practice location without prior notice to the CVBC (then the BCVMA) contrary to section 22.1, 22.2 and 37(5) of the Bylaws.
2. Dr. Bratt admitted that he engaged in miscondcut by moving his facility practice location and operating it prior to the decision of the Practice Accreditation Committee contrary to section 38(1) and 41 of the Bylaws.
3. Dr. Bratt's veterinary facility was accredited as a general facility under the Bylaws. Dr. Bratt did not seek accreditation for his practice as an emergency facility, which is a distinct, specialised facility. Dr. Bratt employed a red neon "Emergency" sign in the window of this clinic. The Discipline Committee found that the existence of the neon sign, whether lit or unlit, was reasonably capable of misleading the public into believing either that the faciliy was an emergency facility or that the clinic had the available resources including the time needed to manage some emergency cases. the Discipline Committee therefore found that the conduct of displaying the "Emergency" sign during the period of July 10, 2010 to November 2010 was misconduct that amounted to a breach of sections 103 and 104 of the Code of Ethics concerning advertising by a veterinarian.
Disposition: The Discipline Committee accepted the joint submission on penalty proposed by Dr. Bratt and counsel for the CVBC. Dr. Bratt was:
a) ordered to pay a fine in the amount of $1,500 on each of count 1 and 2; and a fine of $4,500 on count 3, for a total fine of $7,500.
b) required to remove the "Emergency" sign by 11:00 a.m. on Thursday, November 15, 2012; and,
c) ordered to pay 50% of the costs of the investigation and the discipline hearing.
Dr. Bratt also undertook not to erect any sign using or displaying the word "emergency" unless and until his facility is accredited as an emergency clinic.

Decision: On August 16, 2012 the Investigation Committee approved the executed Consent Order.
Description & Reasons: Dr. Drosdovech failed to review previous medical records on a patient, used a toxic substance not approved by Health Canada and not approved for sale in Canada to treat lymphoma in a dog, which caused a severe adverse reaction. Dr. Drosdovech agrees not to use, prescribe, recommend or administer any drug or therapeutic substance that has not been approved for distribution in Canada by Health Canada. She agrees to inform owners of consequences of off-label use. She agrees to attend specific continuing education, pay a fine of $5000, and 50% of the costs of the investigation.

Decision: On November 29, 2012 the Investigation Committee approved the executed Consent Order.
Description & Reasons: Dr. Orser and the CVBC have reached a Consent Order wherein Dr. Orser admits that in the case of patient Mika a request for the transfer of medical records was not fulfilled in a timely manner by an associate veterinarian. As the Designated Member for Alouette Animal Hospital it is Dr. Orser's responsibility to ensure staff comply with the obligations and requirements of Bylaws 86 and 91 of the CVBC. Dr. Orser accepts that the failure to comply with the bylaws is deserving of a reprimand. Dr. Orser undertakes to remind all staff of obligations and requirements of Bylaws 86 & 89. The CVBC assessed Dr. Orser $2,000 to defray the costs of investigating the matter.

Description & Reasons: Dr. Janne Potter and the CVBC have reached a Consent Agreement wherin Dr. Potter undertakes to use her facility prescription pad only to prescribe prescriptions, to create and maintain better medical records including records including initials for each entry, and to pay costs to the CVBC in the amount of $600. The CVBC considers this agreement is necessary in the public interest that records be of a nature to facilitate tracing of prescription requisitions to their source.
